Implementation Plan of Legal Aid (2011)

(Abridgement)

In February, the Legal Aid Center of M.O.J China (LAC) developed its implementation plan in details, according to the Main Points of Legal Aid Work of M.O.J (2011), to promote the legal aid work. The main points of the Implementation Plan are following:

1. To innovate and expand actively the legal aid publicity and education.     

The legal aid publicity and education is further targeted to the vulnerable in our society by using fully traditional and modernizing media, such as TV, newspaper and websites. Firstly, to strengthen the legal aid publicity for the special people, for example, migrant workers, rural children, unemployed young people, and persons of terminated rehabilitation of community correction. Making the best use of the legal aid publicity, to avoid, resolve social issues and to promote the government management innovation by the legal aid publicity. Secondly, LAC will enhance the cooperation with the Peasants Daily, considering its strong influence in vast rural areas. LAC will seek to publish a special column on legal aid every month in the peasants daily, to conduct jointly all kind of legal aid knowledge prize-giving quizzes and carry out the awareness survey of legal aid in rural areas. Thirdly, LAC will go on enhancing the legal aid public education by developing and giving out freely the legal aid public education products, which are targeted to different localities and different groups of people. These legal aid public education products mainly include the legal aid manuals for peasants, the disable and the elderly etc. Fourthly, LAC will continue to cooperate with a cultural services company, by commissioning the company to interview and edit the Great Love: Access to Legal Aid Staff in China (volume 3). This book is a concentrated reflection of legal aid staff’s strong ethos of public services and hard work. Fifthly, LAC will go on doing well the work related to the management and editing of “a website and a monthly magazine” by improving the quality of a monthly magazine, China Legal Aid and timely updating the website of China Legal Aid in order to fully take their advantage in legal aid publicity and education.

2. To drive forward positively legal aid training work. With the objectives of improving the quality and ability of legal aid staff, lawyers and other legal aid practitioners to serve the vulnerable, meet the demand of legal aid normalization, standardization, legalization, information-based and accessibility, LAC intend to conduct more legal aid training activities, to cover more training contents, to improve training approach and to obtain best training results. Through these methods, LAC will further strengthen the systemization of its legal aid training work and provide a better demonstration/guidance for local training work. Firstly, study and draw up the legal aid training planning over the Twelfth Five-Year Program period on the basis of conscientiously summarizing overall the legal aid training work in Eleventh Five-Year Program period, and especially evaluating the implementation of the West Provincial Legal Aid Rotational Training Planning(is the first part of grass-rooted legal aid institution director rotational training work). Secondly, continue to deliver local legal aid institutions director rotational training work by starting up officially Middle-east Provincial Legal Aid Rotational Training Planning. With the target of improving the management and administrative ability of middle-east grass-rooted legal aid institutions, LAC, as a host or an assistant organizer, will try to complete this Training Planning in two years by providing legal aid training for legal aid institution directors of county level in 19 middle-east provinces. Thirdly, in the west provinces where have finished the training work of management and administrative ability, LAC will initiate new training activities primarily targeted to legal aid business ability so as to improve the ability of cases’ processing of legal aid staff, private lawyers  grass-rooted legal workers and so on. Fourthly, on how to deal with the social targeted people, for example, children left behind in rural areas, young people unemployed, released criminals and people of community corrections, LAC will direct local legal aid institutions in nationwide to develop flexible and diverse special training activities of legal aid business and skill, in order to enhance constantly legal aid professionals’ ability according to the need of the social management innovation. Fifthly, LAC will strengthen the training of techniques and skill on how to provide legal aid advice and psychological guide for the vulnerable, renew legal aid administrative staff’s knowledge and reinforce legal aid practitioners’ ability to deal with social disputes by ADR methods’ on the interest of social harmonies and stabilities. Sixthly, LAC will go on to seek to contact extensively with experts and scholars in order to enlarge the teaching forces, improve training material and etc.

3. To continuously improve legal aid case quality evaluation process. On the basis of summarizing local pilots’ experiences on how to control the quality of legal aid cases, LAC, if possible, will intend to formulate the guideline proposals on developing legal aid case quality assessment process, to direct individual local legal aid institutions to control effectively the quality of legal aid cases, by adopting gradually peer review and other evaluation methods, designing scientifically quality indicators and etc.

4. To improve “12348” hotline services. Firstly, LAC will continuously instruct local legal aid institutions to develop “12348” hotline services. Secondly, LAC will summarize and expand valuable experiences of “12348” hotlines services of local aid institutions, promote local legal aid institutions to combine “12348” hotline services with public legal education, legal aid advices, legal aid applications, public opinion collection/analysis and other activities. LAC fully intends that “12348” hotline services will grow in size and numbers to be a advanced national hotline network, covering functions of delivery of legal aid advices, legal aid publicity/education, receiving legal aid applications and collecting/ analyzing public opinions and so on. Thirdly, if possible, LAC will plan to draft the guideline proposals on strengthening “12348” hotline services on behalf of M.O.J China to direct local aid institutions to carry out “12348” hotline services better.

5. To carry out legal aid research work. LAC will continuously strengthen the study of legal aid basic theory and application. Summarizing local good experiences whilst to develop the prospective study. Firstly, to organize the selection activities of legal aid excellent essays, to publish the Collection of Excellent Legal Aid Essays and distribute to local legal aid institutions and organizations for free. Secondly, to hold the annual legal aid seminar, sharing research achievements, promoting the researchers’ quality and ability. Thirdly, according to the demand of improving legal aid system, LAC will carry out a series of research activities on issues crucial to legal aid strategies and of overall importance, for example, a necessity and feasibility study of contribution from legal aid clients on the basis of experiences from other jurisdictions, the innovation of legal aid delivery methods, the legal aid legislation, the relation between legal aid and social management innovation, the development of legal aid work system, the legal aid case quality management and evaluation, and that of the improvement of legal aid administration.

6. To promote international exchange and cooperation between different jurisdiction. Firstly, to carry out the second stage legal aid cooperation project between Chinese and Canadian’s governments, by initiating officially the implementation of the cooperation programmer in Liao ning, Jin lin and Yun nan provinces. Secondly, go on to expand the international intercourse channels in order to promote the communication and cooperation with legal aid counterparts from other jurisdictions, on the basis of equality and mutual benefit, mutual complementarily and common development.

     Besides, LAC will continue to pilot the methods of project management and formulate the Manual of Performance Management of LAC according to the Implementation Plan. The Manual will design and manage in details each work in the Implementation Plan, around the aims and objectives, primary and secondary tasks, individual methods, business process, timelines, risk management, input-output and evaluation. All divisions and staff of LAC will play an important role in carrying out individual tasks on the Implementation Plan. LAC will assess the individual tasks quarterly. LAC intends to further promote the ability of the staff as a whole and raise the working efficiency.
